Qualified provides this Privacy Policy (“Privacy Policy”) to let you know our policies and procedures regarding the collection, use and disclosure Personal Information from Users of our website (the “Site”), and any other related websites, features, applications, widgets or online services that are owned or controlled by Qualified and that post a link to or incorporate the terms of this Privacy Policy (together with the Site, the “Services”).

This Privacy Policy applies to the activities for which Qualified is a “data controller” which means that Qualified decides why and how Personal Information is processed. This Privacy Policy also explains the collection, use, purpose, and sharing of Personally Identifiable Information related to Qualified ’s services. 1. Personal Information We Collect and How We Use It.

Visitors to our website may choose to interact with Qualified in ways that require Qualified to gather Personal Information. The amount and type of information that Qualified gathers depends on the nature of the interaction. For example, we ask visitors who sign up at Qualified.io to provide an email address, and information necessary for processing payments, completing a Developer Assessment, delivering the Assessment Link and Assessment Report. In each case, Qualified collects such information only insofar as is necessary or appropriate to fulfill the purpose of the visitor’s interaction with Qualified. Qualified also may collect statistics about the behavior of visitors to its websites. Qualified does not disclose Personal Information other than as described below. Visitors can always refuse to supply Personal Information, with the caveat that it may prevent them from engaging in certain website-related activities.

If you are in the European Economic Area or the United Kingdom, we only process your Personal Information when we have a valid “legal basis,” including as set forth below.

When You Use Our Website

Like most website operators, Qualified collects non-personally identifying information of the sort that web browsers and servers typically make available, such as the browser type, language preference, referring site, and the date and time of each visitor request. Our purpose in collecting non-personally identifying information is to better understand how our visitors use our website. Sometimes, Qualified may release non-personally identifying information in the aggregate, e.g., by publishing a report on trends in its website's usage.

A visitor's IP address may be logged within our system, typically for debugging purposes, separate from our system application databases. The IP address may remain stored within our logs for up to 3 months.

When You Submit an Enquiry on Our Website

When you submit an enquiry via our website, we ask you for your name, contact telephone number, company, job title and email address. Qualified may also ask you to provide additional information, such as number of employees.

We use this information to respond to your query, including providing you with any requested information about our products and services. We may also email you after your enquiry to follow up on your interest and ensure we have answered your it to your satisfaction. We will do this based on our legitimate interest in providing accurate information prior to a sale. We keep enquiry emails for three years, after which they are securely archived and kept for seven years, when we delete them.

When You Purchase a Product from Our Website

When you purchase products from us online, we ask you for your name, address, contact telephone number, email address and credit card information.

We will use your information to verify your credit card details for your purchase, process your order and to subscribe you to our products. We will also send you a receipt via email and we may use your telephone number to contact you regarding your purchase.

We require this information in order to process your payment, deliver your products or services and fulfill our contract with you.

Your information is stored on our website and on our cloud servers, both of which are based within the United States. Your credit card details are passed directly to a third-party payment processor which is based in the United States and is certified to the EU-US Privacy Shield (which requires effective safeguards for your information). We do not retain your credit card information.

We keep your order information for an indefinite period, for our accounting purposes.

When You Take an Assessment via our Website

As a visitor, you may be requested by one of our customers to take an assessment. In this case, Qualified is acting as a data processor, not a data controller. The process of taking an assessment will ask you for your name and email address. This is required so that the customer (data controller) may identify who you are after you have submitted your assessment.

During the assessment, additional Personal and Non-Personal information may be requested. This information requested is determined and controlled by our customers (data controllers). During the assessment process you may be asked to permit verification via image and/or video, and this verification will be recorded for internal review purposes only. All images and videos sourced during the assessment process will be stored in accordance with our Data Security And Protection Policy. You reserve the right to refuse to be recorded and/or have your image captured. In the event you choose not to have your image captured and/or recorded, we reserve the right to discontinue the assessment process.

Visitors can always refuse to provide requested personal information, with the caveat that it may prevent them from being able to start or complete the assessment.

Our customers, typically employers or schools which visitors take assessments for, by default are in control of the personal data you provide. They may keep the information for up to an indefinite time. A customer may choose to enact their own data retention policy in accordance with their country’s laws.

At any point, you may request that your Personal Information be removed. We will comply with this request within 72 hours (about 3 days). To submit a request regarding your personal data by email or post, please use the contact information provided in the ‘Contact Us” section of this policy.

When You Take Part in Our Feedback Survey

When you take part in our feedback survey, we record your name, your email address, and may ask for your organization name, your job role, and your answers to questions we ask about your opinion of, and use of, our products and services.

We use this information to develop and improve our products and services and our customer relationships. Your job role, organization, and some or all your comments may be publicly displayed on our website as a testimonial. We will do this based on our legitimate interest in marketing our products and services.

Your details are shared with a third-party surveys system which is based within the United States.

We do not use the information you provide to make any automated decisions that might affect you.

Your personal data is stored for three years, or for as long as we are marketing the product or services that the review refers to, whichever is shorter. You may ask us to remove a testimonial that is based on your feedback from our website at any time.

Information Protection and Disclosure

Qualified will only disclose potentially personally identifying and Personal Information to its employees, contractors, and affiliated organizations that i. needs to know that information to process it on our behalf or to provide services available at our websites, and ii. that have agreed not to disclose it to others. Some of those employees, contractors and affiliated organizations may be outside your home country. By using our websites, you consent to the transfer of such information to them. Qualified will not share or sell your Personal Information to other organizations for commercial purposes, except when we have your permission to provide you with products or services that you have requested. If you are a registered user of a Qualified website and have supplied your email address, Qualified may occasionally send you an email to tell you about new features, solicit your feedback, or just keep you up to date with what is going on with Qualified and our products. If you send us a request (for example, via a support email or one of our feedback mechanisms), we reserve the right to publish it to help us clarify or respond to your request or support other users. International Data Transfers
